Consumer distance selling regulations

My sis ordered something online, £20 worth of "goods," paid by debit card on the 27th December. The money has been taken from her account on the 28th December. Not received any other communication from the company or any goods.

She first contacted the company by email, around 2 weeks after placing the order, no reply. Emailed again 3 days ago, no reply. Emailed today, no reply. Phoned them and it just rings and rings.

I have had a quick shifty at the consumer distance selling regs but dont really see much regarding this situation but I think I did see something somewhere about getting payment back.

She has contacted her bank who issued the debit card and they said the only thing they can do is issue a statement to prove the money has been taken from her account.

Any suggestions?

It sounds to me like a con job. There was one reported just after christmas selling Wii's. The con men set up a bank account, website etc.then take the money and run. Apparently it is fairly easy to do. Soz if that's the case Butch.

As far as Im aware theres nothing you can do even if you do find them, as its just your word against theirs.

Would seem they also have an outlet through Ebay. Reading the feedback, the shit must have hit the fan around Nov 07 as they have had quite a few negative feedbacks.

Told my sis to put her complaint in writing and send it to them registered delivery ( so she will know if its received) and phone trading standards for advice.

dunno if she payed with her bank card? but if its a VISA debit she should be covered and get her moneys back.

take them to the small claims court. its alot hassle but should be done out of principle.

unfortuanly the amount is too small to actually get any justice on them, it is also too small to get a claim back via the credit card or bank.

What i would do is put all of the info on here (or email me it) and then we can investigate, find the ISP and maybe IP of the user who took the money, try and sort it out that way. Or find the bank that the money was transacted to.
